Jayson Q. Marasigan, Esq.

Jayson Q. Marasigan’s practice emphasizes in business litigation, contractual disputes, real estate litigation, unfair competition, misappropriation of trade secrets, and other business torts. Mr. Marasigan strives to achieve the best results for his clients, whatever the circumstances. Mr. Marasigan received his Bachelor of Arts Degree in Political Science from California State University Northridge, graduating magna cum laude. He received his Juris Doctor Degree from Loyola Law School in Los Angeles in 2003. While at Loyola, Mr. Marasigan received distinguished marks. He made the Dean’s list during all three years of law school. He also received first honors awards in Construction Law and Insurance Litigation.  Mr. Marasigan began practicing as an attorney after passing the Bar in 2003.  Mr. Marasigan is licensed to practice before all California State Courts in addition to federal courts in California.  Mr. Marasigan has been selected among the Super Lawyers® – Rising Stars edition in 2009, 2010, 2011, 2012, 2015, 2016, 2017 and 2018.  Mr. Marasigan received this accolade in recognition of his being among the top attorneys who are 40 years old or younger. In 2015, after a bench trial, the Superior Court Judge found a defendant guilty of contempt in having violated a judgment permanently prohibiting him from using a particular word in his trade name, advertising or marketing. The Superior Court Judge found that he had violated the injunction beyond a reasonable doubt when he adopted a trade name that simply misspelled the prohibited word. The attorneys at Marasigan Law Practice were able to convince the Judge that the newly adopted trade name was a “contrivance” and that the defendant had intentionally adopted the trade name to perform an end-run around the prior judgment.

In 2014, after a 6-week trial, the attorneys of Marasigan Law Practice were successful in defending their client against claims brought by a business partner. The plaintiff in the case alleged claims of fraud, breach of contract and breach of fiduciary duty. The damages sought by the plaintiff were in excess of thirteen-million-dollars ($13,000,000), plus punitive damages. At the conclusion of plaintiff’s case-in-chief, Marasigan Law Practice moved for, and was granted, a defense judgment for their client on all claims. In addition, the Court awarded Marasigan Law Practice’s client attorneys’ fees and costs in excess of three-hundred-thousand-dollars ($300,000).

In 2014, the attorneys of Marasigan Law Practice were successful in obtaining a dismissal of 20 individual clients named as defendants in a business litigation law-suit brought against them by an individual Plaintiff claiming among other things, that in return for his accepting employment at a Company and sharing certain intellectual property and business contacts with the Company, the Company and its individual owners agreed to sell the Company to Plaintiff. Marasigan’s clients disputed the allegations and the attorneys vigorously defended the lawsuit. Marasigan Law Practice was able to obtain a dismissal of the lawsuit for its 20 clients.

Marasigan Law Practice represented beneficiaries to an amended trust. The original trust gave the lion’s share of the decedent’s estate to one of her nieces, whom she lived with. The decedent amended her trust, on her own, while she was in a convalescent home. The amended trust split the decedent’s estate more evenly amongst her friends and relatives. The niece who stood to take most of the estate under the original trust filed a petition to declare the trust amendment null and void based upon elder abuse and lack of capacity. After a two-week trial, the attorneys at Marasigan Law Practice were able to convince the Judge that the trust amendment was not the product of undue influence. The Judge went further by finding that the decedent had capacity to execute the trust amendment, relying on testimony from both the decedent’s relatives and the Court-appointed expert, Dr. James Spar (the same doctor who opined that Donald Sterling was incompetent to continue serving as trustee of the trust that owned the Los Angeles Clippers). In addition to the estate plan having been upheld, Marasigan Law Practice’s clients were awarded their attorney’s fees and costs.

Marasigan Law Practice represented four adult children of a 94-year-old man who died on April 17, 2009. After his passing, the children discovered that their father had named his caregiver the sole beneficiary of his estate and trust. The children filed a trust/will contest challenging the validity of the trust and will under Probate Code section 21350, prohibiting caregivers from receiving “donative transfers” from “dependent adults”. After extensive discovery and a four-day trial, the Superior Court Judge found that the caregiver was a disqualified beneficiary. Judgment was entered against the caregiver, which included an award of attorney’s fees and costs.

Marasigan Law Practice defended a client in a defamation case involving his ex-girlfriend. Marasigan filed a motion to dismiss the lawsuit under the Anti-SLAPP statutes which prohibit lawsuits that are strategically aimed at chilling protected speech. The court dismissed the lawsuit and awarded the client his attorney’s fees and costs.

Marasigan represented a franchisor in a dispute with one of its franchisees. The franchisor filed a claim alleging that the franchisee owed royalty payments, advertising fees, and the balance of a secured promissory note. The franchisee filed a counter-claim alleging the franchisor’s failure to provide the requisite statutory notice of non-renewal of the franchise, breach of the franchise agreement, and misrepresentation. After arbitration, the franchisor was awarded all money owed to it by the franchisee, plus prejudgment interest, costs and attorney’s fees incurred in the arbitration.

The attorneys at Marasigan Law Practice defended a landlord being sued by a tenant for alleged retaliatory conduct. The tenant, who is still occupying the landlord’s commercial property, dismissed the action on the eve of trial. There being no attorney’s fees provision in the commercial lease agreement, the attorneys at Marasigan Law Practice looked to other means of recovering fees and costs against the tenant. Under California Civil Code section 1942.5, a court is required to award attorney’s fees to a prevailing party in an action brought for retaliatory eviction if such fees are requested upon the initiation of the action. Recovery of attorney’s fees in the subject action, however, was not a foregone conclusion. Though attorney’s fees were requested in the initial pleadings, tenant’s causes of action were labeled “malicious prosecution” rather than “retaliatory eviction”. The Superior Court, looking at the thrust of the tenant’s claims, decided that they were grounded in retaliatory eviction and awarded $44,056.50 in attorney’s fees and costs to the landlord. It is important for landlords and tenants to note that the trial courts have discretion to determine the prevailing party in cases brought pursuant to Civil Code section 1942.5. A prevailing party in such cases is to be the party who realized its litigation objectives on a practical level.

In August 2009, the attorneys at Marasigan Law Practice settled a personal injury claim for a sum in excess of $1.24 million dollars.
